Terms of Service

Section 1

Acceptance

By accessing dataixai.com or using Dataix services you agree to these Terms of Service. If you are accessing on behalf of an organization you represent that you have authority to bind that organization to these terms.

If you do not agree to these terms, do not access or use our website or services.

Section 2

Services

Dataix provides forensic revenue reconciliation services including diagnostic analysis, full engagement reconciliation, Revenue Integrity Reports, Revenue Integrity Certificates, and ongoing monitoring services as described in separately executed engagement agreements.

All services are subject to availability and may be modified or discontinued at any time. We reserve the right to refuse service to any party at our sole discretion.

Section 3

Engagement Agreements

All services are governed by separately executed Statements of Work and Master Services Agreements. These Terms govern website access and general service relationships. Specific engagement terms supersede these Terms where there is conflict.

No engagement is effective until a written agreement has been executed by authorized representatives of both parties.

Section 4

Disclaimer of Warranties

Dataix services are provided based on data supplied by the client. Findings represent documented discrepancies in that data and do not constitute a guarantee of revenue recovery. Actual recovery depends on payer adjudication decisions, timely filing compliance, and client execution of remediation actions outside Dataix's control.

Services are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Section 5

Limitation of Liability

Dataix's total liability for any claim arising from services shall not exceed the total fees paid by client in the 12 months preceding the claim. Dataix is not liable for indirect, consequential, special, incidental, or punitive damages, including but not limited to lost profits or lost revenue, regardless of whether such damages were foreseeable or whether Dataix has been advised of the possibility of such damages.

Section 6

Intellectual Property

FORT (Forensic Operational Revenue Tracker) and VERA (Valuation Error and Revenue Audit Engine) are proprietary methodologies of Dataix LLC. All reports, certificates, and deliverables produced by Dataix are licensed to the client for internal use only.

Unauthorized reproduction, distribution, resale, or public disclosure of Dataix deliverables is prohibited. This restriction survives termination of the engagement.

Section 7

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Disputes shall be resolved exclusively in the state or federal courts located in New Jersey, and each party consents to personal jurisdiction in those courts.
